Introduction

Welcome to BMW To Go, an online marketplace designed to connect people looking to buy and sell BMW cars across the UK.

These Terms & Conditions govern your access to and use of the BMW To Go website and its associated services.

By accessing BMW To Go, creating an account, submitting a vehicle listing or otherwise using our services, you agree to these Terms & Conditions.

If you do not agree with these terms, you should not use our website or services.

Our Role

BMW To Go provides an online marketplace that allows sellers to advertise BMW vehicles and prospective buyers to discover and contact sellers.

Unless explicitly stated otherwise, BMW To Go does not own, inspect, sell or purchase the vehicles advertised on the platform and is not a party to any transaction between a buyer and seller.

Buyers and sellers are responsible for communicating with each other, carrying out appropriate checks, negotiating the price and terms of any transaction, and completing the sale.

BMW To Go does not guarantee that a vehicle will sell or that a seller will receive enquiries as a result of advertising on the platform.

Listing Fees

A listing fee may apply when advertising a BMW on BMW To Go.

The applicable price, duration and features of each advertising package will be displayed when creating or purchasing a listing.

Any additional promotional services, featured placement or upgrades will also be displayed before purchase.

Prices may change from time to time. Any changes will not affect advertising services that have already been purchased unless otherwise stated.

Refunds

Once a vehicle listing has been published publicly on BMW To Go, the advertising service is considered to have begun.

Refund requests made within 3 days of publication may be considered where appropriate.

After 3 days have passed, listing fees are generally non-refundable.

However, in exceptional circumstances, if a listing has received no listing views or phone number reveals from potential buyers, we may consider offering a full refund at our discretion.

Any discretionary refund will be assessed on a case-by-case basis and does not create an automatic entitlement to a refund in future circumstances.

Nothing in these Terms & Conditions is intended to limit any statutory rights you may have under applicable UK consumer law.

Vehicle Transactions

BMW To Go does not charge a commission or transaction fee on the final sale price of a vehicle unless explicitly stated otherwise.

Any negotiation, payment, vehicle inspection, collection, delivery or transfer of ownership takes place directly between the buyer and seller.

BMW To Go does not:

• Determine the final sale price of a vehicle
• Hold funds on behalf of buyers or sellers
• Guarantee payment from a buyer
• Guarantee the condition or description of a vehicle
• Guarantee the identity or intentions of any user
• Provide a warranty for vehicles advertised through the marketplace
• Automatically inspect or verify vehicles before they are advertised

Users should carry out their own checks before entering into any transaction.

Vehicle Listings

Sellers are responsible for ensuring that all information contained within their listing is accurate, truthful and not misleading.

This includes, where applicable:

• Vehicle make and model
• Registration year
• Mileage
• Engine and fuel type
• Transmission
• Specification
• Vehicle condition
• Service history
• MOT information
• Asking price
• Photographs
• Details of modifications
• Details of known faults or damage

Sellers must have the legal right or appropriate authority to advertise the vehicle.

You must not knowingly provide false, misleading or fraudulent information within a listing.

Listing Photographs and Content

By uploading photographs, descriptions or other content to BMW To Go, you confirm that you own the content or otherwise have the necessary permission to use it.

You grant BMW To Go permission to display, reproduce, resize, format and use this content where reasonably necessary to provide and promote our marketplace and your vehicle listing.

This permission includes displaying your listing content on BMW To Go and promoting the vehicle through BMW To Go’s marketing channels.

Social Media and Marketing Publication

When you publish a vehicle listing on BMW To Go, you agree that we may promote your vehicle through our marketing channels to increase its exposure to potential buyers.

This may include:

• Facebook
• Instagram
• Other social media platforms
• Email marketing
• Online advertising
• BMW To Go promotional content

Promotional material may include photographs, vehicle details, asking price and other information contained within your public listing.

If your vehicle has sold or you would like a promotional post relating to your listing removed, please contact us.

Where reasonably possible, we aim to remove requested social media posts controlled directly by BMW To Go within 24 hours of receiving the request.

Buyer Responsibilities

Buyers are responsible for carrying out appropriate checks before purchasing a vehicle advertised on BMW To Go.

We strongly recommend that buyers independently verify important information before completing a transaction.

This may include checking:

• Vehicle identity
• V5C information
• MOT history
• Service history
• Mileage
• Outstanding finance
• Insurance write-off history
• Vehicle condition
• Seller identity
• Vehicle Identification Number (VIN)

Buyers should inspect and, where appropriate, test drive a vehicle before purchasing it.

For higher-value or specialist vehicles, buyers may also wish to arrange an independent vehicle inspection.

Seller Responsibilities

Sellers are responsible for:

• Providing accurate and truthful information
• Keeping their listing reasonably up to date
• Responding appropriately to genuine buyer enquiries
• Informing potential buyers about relevant known faults or issues
• Ensuring they have authority to sell the vehicle
• Complying with applicable laws and regulations
• Marking or removing the listing when the vehicle is no longer available

BMW To Go reserves the right to edit, suspend or remove listings that we reasonably believe breach these Terms & Conditions or may present a risk to users.

Fraud and Scams

Users should remain vigilant when communicating with buyers and sellers online.

BMW To Go will never guarantee that every person using the marketplace is genuine.

Users should be particularly cautious of anyone who:

• Requests payment before a vehicle has been properly inspected
• Requests payment through unusual methods
• Sends suspicious links
• Requests unnecessary personal or financial information
• Pressures a seller to purchase a vehicle history report from a specific unfamiliar website
• Claims payment has been made without reliable evidence
• Makes an offer that appears unusually complicated or suspicious

BMW To Go is not responsible for losses resulting from transactions, fraudulent activity or communications between users where such losses are outside our reasonable control.

If you receive a suspicious message connected with a BMW To Go listing, please contact us so that we can investigate where appropriate.

User Accounts

Certain features of BMW To Go may require users to create an account.

You are responsible for maintaining the security of your account details and for activity carried out through your account.

You must provide accurate information when creating or using an account.

You must not use another person’s account without their permission or attempt to gain unauthorised access to another user’s account.

BMW To Go reserves the right to suspend or terminate accounts where we reasonably believe there has been misuse, fraudulent activity or a breach of these Terms & Conditions.

Prohibited Use

You must not use BMW To Go to:

• Advertise stolen vehicles
• Publish fraudulent or misleading listings
• Impersonate another person or business
• Attempt to defraud another user
• Send spam or unsolicited commercial messages
• Distribute malicious software or harmful links
• Scrape or systematically extract website data without permission
• Interfere with the operation or security of the website
• Use the marketplace for unlawful purposes
• Harass, threaten or abuse other users

We reserve the right to restrict access, remove content or suspend accounts where these rules are breached.

Removal or Suspension of Listings

BMW To Go reserves the right to reject, edit, suspend or remove a listing where we reasonably believe:

• The listing contains false or misleading information
• The vehicle may be fraudulent or stolen
• The seller does not have authority to advertise the vehicle
• The listing breaches these Terms & Conditions
• The listing contains inappropriate or unlawful material
• The listing poses a potential risk to users
• The listing is being used for purposes unrelated to selling the advertised vehicle

Where appropriate, we may contact the seller before taking action.

Featured and Promoted Listings

BMW To Go may offer paid upgrades that provide additional visibility, such as featured listings or priority placement.

Purchasing a promotional upgrade does not guarantee a specific number of views, enquiries or a successful sale.

The visibility of any listing may depend on factors including buyer demand, search criteria, vehicle specification, asking price and the number of other vehicles available.

Business Sellers

Dealers and other professional vehicle sellers using BMW To Go are responsible for complying with all legislation and regulations applicable to motor traders and businesses selling vehicles to consumers.

Business sellers must not present themselves as private sellers in order to avoid their legal responsibilities.

BMW To Go may offer separate packages, pricing or account features to business sellers.

Marketing Communications

Where permitted by applicable law and according to the marketing preferences you have provided, BMW To Go may contact users by email or SMS with relevant marketplace updates, offers, service information, reminders and promotional communications.

Marketing communications may be managed using third-party communication providers.

You can opt out of marketing communications at any time using the unsubscribe instructions included within the communication.

Where SMS marketing is used, you may also be able to opt out by replying STOP, where stated in the message.

Opting out of marketing communications will not necessarily prevent us from sending essential service-related communications relating to your account, listing, transaction with BMW To Go or security.

We do not sell your personal information to third parties for their own marketing purposes.

Intellectual Property

Unless otherwise stated, the BMW To Go website, branding, design, written content and other materials created by BMW To Go are owned by or licensed to BMW To Go and are protected by applicable intellectual property laws.

Vehicle photographs and descriptions uploaded by users remain subject to the rights of their respective owners, while being licensed to BMW To Go as described within these Terms & Conditions.

BMW To Go is an independent marketplace and is not affiliated with, endorsed by or sponsored by BMW AG unless expressly stated otherwise.

BMW and associated trademarks remain the property of their respective owners.

Website Availability

We aim to keep BMW To Go available and operating reliably, but we cannot guarantee uninterrupted access.

BMW To Go acts as an advertising marketplace and does not independently verify every statement made within vehicle listings.

Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded under UK law.

Your use of BMW To Go is also subject to our Privacy Policy.

Our Privacy Policy explains how we collect, use, store and protect personal information when you use the website and our services.

Changes to These Terms

BMW To Go may amend or update these Terms & Conditions from time to time.
